At a minimum, the liability insurance must cover any losses to a third party for bodily injury, death or property damage. Many Idaho Courts consider it a serious crime when someone is caught operating a motor vehicle on a public road without having liability insurance. The reasoning behind this view makes sense when we consider the possible losses other drivers could incur if they are involved in an accident and are not at fault. If they have nothing more than a liability insurance plan themselves, there would be no insurance policy to cover their property damage and medical bills.
If you are charged with a misdemeanor for driving without insurance, it is important that you consult with and obtain an Idaho attorney to get the charges resolved and preferably dismissed. The penalties possible for failure to maintain liability insurance range anywhere from a seventy-five dollar ($75.00) fine all the way up to a thousand dollar fine ($1000.00) and up to six months in jail. A first time offense within a five (5) year period is an infraction in Idaho. Any subsequent offenses for failure to purchase liability insurance within a five year period will be charged as a misdemeanor. Ultimately, the Idaho Department of Transportation will suspend a driver’s driving privileges if a charge of failure to purchase is not handled correctly. To the surprise of many drivers, they are charged with failure to purchase liability insurance, the case is not handled properly, the person then gets pulled over later on not knowing that their driver’s license has been suspended and the police officer issues them a ticket for driving without privileges (DWP). The Penalties for DWP are serious.
